PHOENIX, Ariz. (KPNX) — Arizona's 15-week abortion ban has been officially declared "unconstitutional" after voters overwhelmingly supported protecting access to abortions in the Grand Canyon State. A Maricopa County judge issued a ruling this week in a civil case filed after Prop. 139 was approved by voters last November and enshrined abortion rights into the state constitution. Judge Frank Moskowitz ruled the state was "permanently and forever enjoined and restrained" from enforcing any of the provisions of Arizona's former abortion restrictions. The legality of abortions in Arizona has been in flux since the U.S. Supreme Court overturned the landmark Roe v. Wade decision and allowed states to decide how to regulate reproductive rights. After Roe was overturned, officials in Arizona spent years litigating and debating which of the state's abortion laws should take precedent, eventually resulting in the issue being placed on the ballot for the voters to decide. “Arizonans made it crystal clear that reproductive freedom is a core value in their state by passing Prop 139 in November, establishing a fundamental constitutional right to abortion," Rebecca Chan, an ACLU attorney, said in a statement.
