VIRGINIA BEACH, Va. — Virginia Beach police say they have made an arrest in connection with a shooting that killed a 17-year-old in mid-April.

In the early hours of April 14, officers were dispatched to the 200 block of S. Budding Avenue for a report of shots fired. Officers arrived to find someone had shot into a home, and that a bullet had traveled through the house and struck a 17-year-old boy in the head. The teen did not survive.

Later that same day , Virginia Beach police responded to the 4100 block of Sassafras Court for a report of shots fired.

Two people were found with gunshot wounds, and they were both taken to the hospital. One of the victims, 18-year-old Josiah Spann of Virginia Beach, was charged for that incident with armed robbery, aggravated malicious wounding, shooting in the commission of a felony, and use of a firearm in the commission of a felony.

Investigators said they discovered messages Spann allegedly sent to the S. Budding Avenue victim just two hours before the shooting, in which he reportedly threatened to shoot him. He has been charged with first-degree murder and use of a firearm in the commission of a felony for that shooting.

According to the criminal complaint against Spann, a victim of the Sassafras Court shooting told police he had been approached by someone asking for a lighter. As he turned to retrieve it, he said he saw another man walking up behind him with a gun. The victim claims the man robbed him and stole his cellphone.

The complaint states the victim was able to shoot the suspect before he fled. Police say they later found Spann on Wales Drive with a gunshot wound. While Spann allegedly admitted to being on Sassafras Court at the time of the incident, the complaint said he did not confess to the robbery.

A stolen gun recovered at the scene of the Sassasfras Court shooting was linked to the S. Budding Avenue homicide by using the Integrated Ballistic Information Network.

“These incidents are a vivid reminder that stolen firearms are frequently used to commit violent crime,” said VBPD Chief Paul Neudigate.

“In this case, an individual visiting from South Carolina to our Resort Area realized once they returned home their firearm had been stolen out of their vehicle. That same firearm was subsequently used in the death of one individual and serious injury of another. Negligence enabled a criminal to carry out two horrendous acts of violence.”

Spann is currently being held without bond and faces a total of eight charges in connection with both cases.
